Terms of Use
These Terms are the agreement between you and JOph. They explain what the platform does, what you can and cannot do with it, how payments work, and how disputes are resolved — under the laws of the Republic of the Philippines.

This agreement is between you (the user of JOph) and [Registered Business Name], the operator of JOph, registered with the [DTI/SEC] under business registration no. [Registration No.], TIN [TIN], with principal office at [Complete business address, Philippines] ("JOph", "we", "us").
- "Platform" — the JOph mobile app and website.
- "Service Provider" (or provider) — a user who offers services through Job Orders.
- "Requestor" (or customer) — a user who accepts books or accepts a Job Order from a provider.
- "Job Order" (JO) — the record on the Platform describing a service: scope, terms, price, schedule, and status logs.
- "Personnel" — an individual a provider sends to perform work, carrying a permanent Personnel QR.
2. Acceptance of these Terms
You accept these Terms when you create a JOph account by tapping "I agree" on the signup screen, and each time you use the Platform afterward. By accepting, you confirm that you are at least 18 years old (or the age of legal majority in your place of residence), that you have the legal capacity to enter into this contract, and that the information you provide is true. If you are accepting on behalf of a business, you confirm you are authorized to bind that business.
3. What JOph is — and is not
JOph is a peer-to-peer platform: it lets service providers create reusable Job Order templates, share tamper-proof QR codes, and transact with verified customers, with one record updating live on both sides.
Equally important — JOph is not:
- An employer. Service Providers are independent contractors. We do not set their rates, schedules, or methods, and we provide no employment benefits, guarantees, or statutory protections.
- A party to your transaction. The Job Order contract is between the customer and the provider alone.
- A payment intermediary. We do not hold, escrow, process, or take a cut of payments. Customers pay providers directly.
- A guarantor or insurer. We verify identities, but we do not guarantee the quality, legality, safety, or completion of any service, and we do not provide insurance unless we expressly say so in writing.
- Your tax agent. You are solely responsible for declaring your income and complying with BIR and local permit requirements.
4. Accounts & security
- One account per person. Duplicate accounts may be suspended.
- Provide accurate, current information and keep it updated.
- Keep your password and the app's PIN/biometric gate secure. You are responsible for all activity under your account.
- Never share your login credentials or let anyone else use your account.
- Notify us immediately at support@joph.app if you suspect unauthorized access.
5. Identity verification
- Verification through in-app camera capture (a government ID plus a live selfie holding it) is mandatory for all users and personnel before transacting.
- Acceptable IDs are those listed in the app (e.g., PhilSys/PhilID, UMID, driver's license, passport, PRC license).
- Submitting fake, altered, or stolen IDs — or someone else's ID — is strictly prohibited and will result in permanent refusal or termination, and may be reported to authorities.
- Failed verification may be retried or appealed through support. We may request re-verification when an ID expires or fraud is suspected.
- You consent to us processing your verification data as described in our Privacy Policy. Raw ID images are deleted after verification completes; other users see only your cropped selfie and verification badge.
6. Prohibited conduct
For all users
- Fraud, scams, or any deceptive practice
- Impersonation or false representation (including fake or borrowed IDs)
- Harassment, discrimination, hate speech, or abuse toward other users
- Requesting or offering illegal services or anything violating law
- Spam or unsolicited marketing through the Platform
- Circumventing the Platform's fee structure or security features
- Sharing accounts, or using bots, scrapers, or automated tools without written permission
- Reverse engineering, scraping, or interfering with the Platform
- Misusing identity-verification data or another user's personal information
For Service Providers
- No-shows or failure to deliver the agreed scope
- Misrepresenting qualifications, skills, or credentials
- Subcontracting work without disclosing it in the Job Order
- Accepting jobs beyond your capacity to deliver
For Requestors
- Posting illegal, unsafe, or harmful job requests
- Refusing to pay for work delivered as agreed
- Abusive or unsafe behavior toward providers or personnel
7. Your content
You keep ownership of the content you create on JOph (profiles, Job Order details, reviews, messages). You grant JOph a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and adapt that content solely as needed to operate, secure, and improve the Platform — for example, showing your profile to counterparties or syncing a Job Order across devices. You confirm you have the rights to the content you post. We may remove content that violates these Terms or the law, and we will act on properly reported copyright or IP infringement by removing the material and, where appropriate, the account.
8. Job Orders & cancellations
- A provider creates a Job Order from a template; a customer accepts it by scanning the provider's QR. Acceptance creates the shared record on both sides.
- Either side may propose changes to scope, schedule, or price — changes take effect when recorded in the Job Order, which both sides see in real time.
- Cancellation: either party may cancel a Job Order before work begins. We encourage honest, prompt cancellation — repeated no-shows or last-minute cancellations affect your record and may lead to suspension.
- Disputes about delivered work should first be raised in the Job Order's Message tab, where the full record lives. If you need us, contact support@joph.app — we will review the shared record and assist in good faith, but the contract remains between the two users.
9. Fees & pricing
- Customers: ₱0, forever. No fees, no subscriptions, no per-transaction charges of any kind.
- Service Providers: ₱0 during Beta. Beta runs until November 30, 2026. After Beta ends, the provider fee is ₱240; we will announce the billing details in-app and by email at least 30 days before charging anything.
- JOph charges no commission and no per-transaction cut, and does not hold customer payments.
- All amounts are in Philippine pesos (PHP) and are exclusive of any taxes that may apply to you.
- If we ever change fees, we give 30 days' notice, and you may cancel before the change takes effect.
10. Payments & refunds
- Customers pay providers directly, by the method the two parties agree on (e.g., e-wallet or cash). JOph does not hold, process, or forward payments.
- The customer records payment in the Job Order by tagging it "Paid" with the amount and time — this becomes part of the shared record both sides keep.
- Refunds are arranged between customer and provider. Consistent with the Consumer Act (RA 7394), our Terms contain nothing that excludes refunds for our own breach. Where a provider received payment and failed to deliver the agreed scope, the provider is expected to refund the customer fairly and promptly; persistent refund disputes can be escalated to support@joph.app, and we may suspend accounts that repeatedly refuse fair refunds.
- Chargebacks or payment disputes initiated outside JOph are between the payer and their payment provider; we can furnish the Job Order record to help either side.
11. Ratings & reviews
After a Job Order, parties may rate and review each other. Ratings reflect other users' opinions, not ours, and we do not guarantee their accuracy. You may respond to a review about you. We remove reviews that are fake, abusive, threaten privacy, or are unrelated to an actual Job Order — report them in-app.
12. Intellectual property
- The Platform — its code, design, logos, and content — is owned by JOph or its licensors and protected by Philippine IP law. JOph and the JOph marks are trademarks of [Registered Business Name].
- We grant you a limited, revocable, non-exclusive license to use the Platform as intended. You may not copy, modify, distribute, sell, or create derivative works from it.
- You may not use the JOph name or logo in your own branding or marketing without our written permission.
13. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose. We verify identities, but verification is a point-in-time check — it is not a guarantee of any user's behavior, skill, or performance, and we do not endorse any provider or customer. You remain responsible for your own due diligence on any transaction.
14. Limitation of liability
Nothing in these Terms limits liability that cannot be limited under Philippine law — including liability for fraud, willful misconduct, gross negligence, violations of law, or death or personal injury caused by negligence.
Subject to that, JOph is not liable for indirect, incidental, special, or consequential damages — including lost profits or lost data — arising from your use of the Platform or from transactions between users. Our total aggregate liability to you for any claim is limited to the total fees you actually paid to us in the 12 months before the claim arose (which, for customers, is ₱0, and during Beta, ₱0 for providers). This clause is read strictly against us as the drafter, as required by law.
15. Indemnification
You agree to indemnify and hold JOph harmless from claims, damages, and reasonable costs arising from: (a) your breach of these Terms; (b) your negligence or misconduct in connection with a transaction; (c) your violation of any law; or (d) content you post that infringes someone's rights. We may control the defense of any claim we are indemnified for, and you agree to cooperate.
16. Suspension & termination
- By you: you may delete your account anytime in the app (Account → Delete) or by emailing support@joph.app. Deletion takes effect within 30 days, subject to the retention periods in our Privacy Policy. Deletion is irreversible.
- By us: we may suspend or terminate an account for breach of these Terms, failed or fraudulent verification, repeated no-shows or refund refusals, or legal risk. Where practical, we give notice and an opportunity to appeal by replying to the notice or writing to support@joph.app.
- Effects: access ends; completed Job Order records are retained per the Privacy Policy; payment and confidentiality obligations survive; sections that by their nature should survive (IP, liability, indemnity, disputes) do survive.
17. Disputes & governing law
- These Terms are governed by the laws of the Republic of the Philippines.
- Before filing a case, the parties agree to try in good faith to resolve the dispute directly with us for at least 30 days (support@joph.app). We will review the shared Job Order record and respond within that period.
- Money claims within the jurisdiction of Philippine small claims courts may be filed there without a lawyer.
- Any case not resolved otherwise shall be brought before the courts of Lipa City, Batangas, Philippines, without prejudice to consumer complaints filed with the DTI or data privacy complaints filed with the NPC.
18. Changes to these Terms
We may amend these Terms as the service evolves. Material changes take effect 30 days after we notify you by email, in-app notice, or posting on the Platform. Continued use after the effective date means you accept the amended Terms. If you do not agree, you may stop using JOph and delete your account before the effective date.
19. General provisions
- Severability — if any clause is held invalid, the rest stays in force, and the invalid clause is modified to the minimum extent necessary.
- Waiver — our failure to enforce a provision is not a waiver of it; waivers must be in writing.
- Assignment — you may not assign your rights or obligations; we may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
- Force majeure — we are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, government action, internet or utility outages).
- Entire agreement — these Terms and our Privacy Policy are the entire agreement between you and JOph and supersede prior understandings. No oral modification applies.
